    Immigration Law Enforcement Blocked

OKLAHOMA CITY (AP) -- A federal judge has issued an order delaying enforcement of Oklahoma's anti-illegal immigration law, saying it is "substantially likely" it is unconstitutional.

U.S. District Judge Robin J. Cauthron issued a preliminary injunction on Wednesday prohibiting enforcement of provisions of the law.

Those provisions subjected employers to penalties for failing to comply with a federal employee verification system designed to prevent the hiring of illegal immigrants.

The decision came on a lawsuit filed by the U.S. Chamber of Commerce, the Oklahoma Chamber and other business groups.

State Chamber official Mike Seney said the ruling was timely since the employer portions of the law were to take effect July 1.

    Re: HB 1804 Blocked

This really bothers me.  When we moved back to Tulsa in Dec. my father-in-law told us about the new law and I was really impressed that Oklahoma had the courage to make such a strict law.  After seeing first hand the damage that unchecked illegals do to a community, an economy, legal immigrants, hispanic Americans, and even their own families, I am very aware of immigration legislation.

People who say our economy depends on illegals have it backwards, and anyone who has ever studied economics at all will see this.  People who come in and take from government programs, send their children to government funded schools, drive on public roads, and never contribute in taxes or any other way are a drain on society.

Not to mention it is illegal.  That means it is WRONG.  Why is there any issue here?  When something is illegal, the law must be enforced even if enforcing it is inconvienient for some people.

I want to know who this judge is and what his history of rulings might be......

The people that cry  about being a business that uses illegal aliens for employees must think we are stupid.. The latino community knows who is illegal and who is not.... These businesses use and abuse the law for the most part, by paying cash and not with holding taxes and S.S. tax.... They say they check the I.D.,s and that should be enough. Well that is just another way to get away with illegal activity. They don't care if the documents are legal or not....

I don't care if you are blue and sport a six inch fur covering of your whole body.......  If you are here illegally and defrauding our country... I want you gone or in jail................

    Re: HB 1804 Blocked

I wish someone had told me about this loophole before I furnished my entire life history, OSBI, City and County background check, fingerprints and several huge chunks of my hair for a 10 panel drug screen just to get a $10.00 an hour job. Hells bells, if the employers don't have to check my identity or background, why am I turning flips and getting scalped to get hired, next time I will just tell them Judge Robin Cauthron says they don't need to know who I am or what I have done to hire me, and if they persist, I will sue them for violating my constitutional rights.

    Re: HB 1804 Blocked

I did some checking today and here is what I found out.

HB 1804 is still active and in effect except for the two articles that are under question. Both of those articles have to do when the employer that hires an illegal immigrant. It has absolutely no basis directed to any rights of an illegal immigrant but only to the pimps that hire them out.

The biggest shocker I found out today was the 7% drop in crime wasn't because we had got rid of illegals that had been doing crimes but because they had been the victims of robbery, time and time again. This comes from the illegal immigrants carrying their earnings on themselves at all times.

So in my opinion this is all the more reason for illegal immigrants to get legal so they can protect themselves from pimps and robbers.

It's still not right for them to be robbed. They were robbed way before all this immigration stuff started.

It has nothing to do with being legal or not.

Court Delays Enforcement of Oklahoma Immigration Law
Judge says "substantially likely" immigration law is unconstitutional
    U.S. Chamber of Commerce News - June 4, 2008
A U.S. District Court judge postponed enforcement of employer-related portions of an Oklahoma immigration law because it is "substantially likely" that the provisions of the law unconstitutionally interfere with federal regulation of the employment of unauthorized workers. Joining as co-plaintiffs are The State Chamber of Oklahoma, Greater Oklahoma City Chamber, Tulsa Metro Chamber, Oklahoma Restaurant Association and Oklahoma Hotel and Lodging Association. A final judgment in Chamber of Commerce of the United States et al. v. Henry is still pending.
"We applaud the court's decision to delay enforcing these portions of Oklahoma's immigration law. Through harsh civil penalties, the Oklahoma law unfairly shifts the burden of immigration enforcement from government onto the backs of businesses," said Robin Conrad, executive vice president of the National Chamber Litigation Center (NCLC) which represents the U.S. Chamber in the litigation. "Piecemeal state legislation is not the answer to our nation's immigration problems."
The Oklahoma law requires employers doing business with the state to use the "Basic Pilot Program" (also known as "E-Verify"), the federal government's voluntary and error riddled experimental program for electronically verifying work eligibility. The court's decision to issue a preliminary injunction was based on its finding that it is "substantially likely" that the state law unconstitutionally imposes civil sanctions on employers who fail to comply. The Oklahoma law's sanctions include increased tax rates, the loss of contracts, and exposure to litigation if an employer "should have known" that an employee was unauthorized to work.
"Conflicting state and local immigration laws are overwhelming American businesses," Conrad said. "Last year alone, over 240 employer-related immigration bills were introduced by at least 45 states. It's time for Congress to enact comprehensive immigration reform."
The National Chamber Litigation Center, the public policy law firm of the U.S. Chamber of Commerce, is a membership organization that advocates fair treatment of business in the courts and before regulatory agencies. The U.S. Chamber of Commerce is the world's largest business federation representing more than 3 million businesses and organizations of every size, sector, and region.
